These Terms of Use (“Terms”) govern your access to and use of the Reef Buddy mobile application and related services (“App”). By downloading, installing, or using the App you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
Certain features require a paid subscription. Payment is charged to your Apple ID account upon purchase confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Your account is charged within 24 hours before renewal. Manage or cancel subscriptions in your App Store account settings. Subscription payments are non-refundable unless required by law.
You agree to use the App only for lawful purposes and in accordance with these Terms. Do not misuse the App, interfere with security features, or attempt to access data you do not own. You are responsible for maintaining the confidentiality of your device and account credentials.
We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or engaged in fraudulent, abusive, or unlawful activity. Upon termination, your right to use the App ends immediately.
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, REEF BUDDY DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, NOR DO WE GUARANTEE THAT ANY DEFECTS WILL BE CORRECTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, REEF BUDDY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP IS LIMITED TO THE AMOUNT YOU PAID (IF ANY) TO USE THE APP DURING THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
We may update the App or these Terms from time to time to improve functionality or address legal and regulatory requirements. Material changes will be notified within the App or via other reasonable means. Continued use after updates takes effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws applicable in France, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Paris, France, unless a different jurisdiction is required by applicable consumer protection laws.
